Terms of Use
1. Provider and scope
Peace of Mind is provided by Ömer Akyürek, Friedrich-Str. 61b, 40217 Düsseldorf, Germany, email hi@oemerax.com. These terms describe the service and any paid features. The license agreement attached to the app in the relevant App Store also applies. Where Apple's Standard Licensed Application End User License Agreement applies, it is available at apple.com/legal/internet-services/itunes/dev/stdeula/. Mandatory consumer rights take precedence.
2. Service
Peace of Mind lets a person voluntarily send a daily check-in and allows approved people to see whether it was received. Reminders and notifications may be available depending on settings, permissions, network access and delivery. A missed check-in does not reliably indicate anyone's health or safety. Peace of Mind is not a medical device, fall detector or emergency service. In an emergency, contact the person directly or call the appropriate emergency number.
3. Accounts and invitations
An account may be required for certain features. Provide accurate contact details and protect access to your account. Invite only people you are entitled to contact. Each invited person decides whether to participate. Avoid repeated or unwanted invitations. People approved within the service may see the daily check-in status. Unauthorized access to other accounts is prohibited.
4. Paid subscriptions
If paid subscriptions are offered, the purchase screen shows the plan, included features, billing period, full price including applicable taxes and any trial terms before you confirm. The offer displayed for your App Store region and account at the time of purchase governs the purchase.
Auto-renewable subscriptions renew according to the applicable offer unless cancelled in time. Apple handles payments for purchases made through the App Store. Manage or cancel an Apple subscription in your Apple Account settings under Subscriptions or at apps.apple.com/account/subscriptions. Deleting a Peace of Mind account does not automatically cancel an Apple subscription. Trial availability depends on the offer and your eligibility. Under the conditions disclosed when you subscribe, a trial may convert to a paid subscription.
5. Statutory rights and refunds
Mandatory statutory consumer rights, including applicable remedies and rights of withdrawal, remain unaffected. Apple's processes for refund requests for App Store purchases are available at reportaproblem.apple.com. Additional pre-contractual information is provided when required by law. Installing the app does not, by itself, extinguish a statutory right of withdrawal.
6. Technical availability
Delivery of check-ins, reminders and notifications depends, among other things, on internet connectivity, device settings and external services. For important concerns, contact your loved one directly. We may protect, maintain and adapt the service to the extent permitted by applicable law.
7. Deletion and privacy
You can request erasure of personal data in accordance with applicable law. Our App Privacy Policy explains data handling and your rights. For questions or deletion requests, contact hi@oemerax.com.
8. Liability and changes
Liability is governed by applicable law. These terms do not exclude liability that cannot lawfully be excluded. Changes to ongoing contracts are made only as permitted by law. We will give notice of material changes where required.
9. Governing law
German law applies, without prejudice to mandatory consumer protections in the country of your habitual residence.
